I want you to be 100% happy with the artwork you choose. You may return a work within 30 days of receiving it for an exchange or for a full refund minus my initial shipping costs.
How to initiate a return. To return a work, it must be in exactly the same condition as when you received it. To start a return, contact me via this website or by email. If you’re requesting a refund rather than an exchange, I’ll issue your refund within 24 hours of receiving the returned artwork and verifying its condition.
Return shipping costs. For smaller artworks (less than 20 x 20 inches), I ask you to cover the cost of return shipping. For larger works, I will share the return shipping cost with you. The percentages will depend on the artwork’s size, the distance it must travel, and whether you are returning the piece for a full refund or making an exchange. We’ll talk about it on a case-by-case basis. My goal is always clear communication and a positive experience for both of us.
Damage During Delivery. If the delivery service damages the artwork, please notify me within 24 hours of receiving it and provide proof of damage. I will reimburse you for the entire purchase price and cover all costs of returning the artwork.
Changes to this policy. I reserve the right to change my return policy anytime; please check it before purchasing.
When you purchase artwork from me, you agree to the terms outlined in this Terms of Purchase Agreement. Please know that I am committed to providing you with artwork you love and will work with you in good faith to resolve any issues.
Copyright. I guarantee my artwork doesn’t violate anyone else’s intellectual property rights. I retain the copyright to my artwork and all reproductions of the artwork, including but not limited to the right to reproduce or license images of my original work after you purchase it. You agree not to reproduce, copy, or license the artwork.
Warranty. If any aspect of the work is defective–for example, if there’s a problem with the hanging hardware–you have 30 days from the date of your purchase to let me know so I can fix the problem.
Now for the boilerplate legal bits:
Assumption of Risk. You agree to accept all risks associated with using the artwork, including but not limited to eating or wearing it (I recommend neither), where and how you hang it, and any applicable taxes, regulations, or legal compliance issues. You understand that I am disclaiming all liability for harm of any kind or nature caused directly or indirectly by the artwork.
Indemnification. You agree to indemnify and hold harmless me and any of my affiliates from any claims, demands, losses, causes of action, damage, lawsuits, or judgments, including attorneys’ fees and costs, arising out of or relating to your actions under this Agreement or misuse of purchased artwork. You agree to defend against any claims, demands, causes of action, lawsuits, or judgments arising out of, or relating to, your participation under this Agreement, unless expressly stated otherwise by me, in writing.
Limitation of Liability. You agree that my liability for any reason shall be no more than the total purchase price of the artwork purchased.
Dispute Resolution. We will do our best to resolve any disagreements through good-faith negotiation. If we can’t, we will use alternative dispute resolution such as mediation or arbitration under the rules of the American Arbitration Association. Mediation or arbitration will take place in the San Francisco Bay Area. We will cooperate to complete the dispute resolution process within 90 days. The outcome of the alternative dispute resolution process will be binding and conclusive and not subject to judicial review. If necessary, we can enforce it in any court of proper jurisdiction.
Governing Law. The laws of the State of California govern this Agreement.
Entire Agreement. This Agreement constitutes the entire Agreement between us concerning the artwork purchase. It supersedes all prior oral or written agreements, understandings, and representations to the extent they relate to this Agreement’s subject matter. We are bound to any changes to this Agreement only if we make the change in writing and both of us sign it.
Severability. If any provision of this Agreement be or becomes invalid or unenforceable under applicable law, the other provisions remain in full effect.
Waiver. If I fail or choose not to exercise any right under this Agreement, that does not waive or negate any further or future rights.
